Terms of service
Effective May 15, 2026
1. Who we are
hitch.exchange is a Thousand Trails membership resale marketplace operated in Indiana. We connect sellers of Thousand Trails membership interests with prospective buyers, and we facilitate transactions end-to-end — marketing listings, handling buyer enquiries, coordinating negotiations, and managing the transfer process with Thousand Trails on the seller's behalf. We are not a party to the membership transfer itself, which is governed by Thousand Trails' own membership agreement and transfer process. hitch.exchange does not act as a legal agent for buyers or sellers and does not owe either party fiduciary duties.
2. Eligibility
You must be at least 18 years old to use this platform. By submitting a listing or enquiry you confirm that you have the legal authority to sell or purchase the membership interest in question and that all information you provide is accurate and complete.
3. Listing your membership
When you submit a listing, you authorise hitch.exchange to:
- Publish your membership details publicly on the platform.
- Receive and respond to buyer enquiries on your behalf.
- Negotiate terms with prospective buyers and coordinate the Thousand Trails transfer process.
- Liaise with Thousand Trails membership services to verify membership status and facilitate transfer.
Your personal contact details are never shared with buyers. All buyer communication is handled by our team. You will be kept informed of material developments.
4. Service fee
There is no fee to list. hitch.exchange charges a service fee only on successful completion of a sale:
8.5% of the agreed sale price
Minimum fee: $149 · Maximum fee: $499
The service fee is invoiced to the seller via a Stripe payment link once the buyer's payment has cleared through Escrow.com. The Thousand Trails transfer process will not be initiated until the service fee is received.
5. Procuring cause and tail clause
If hitch.exchange introduces a buyer to your listing — including through direct enquiry, email communication, or referral — and a sale is subsequently completed with that buyer, the service fee applies regardless of whether the transaction closes through this platform.
This obligation continues for 90 days after your listing is removed from hitch.exchange. This is a standard procuring cause and tail clause standard in marketplace listing agreements.
6. Buyer payments and Escrow.com
When a buyer selects buyer protection, funds are held by Escrow.com, Inc. — a licensed escrow company regulated by the California Department of Financial Protection and Innovation. hitch.exchange does not hold buyer funds at any point. Escrow.com releases funds to the seller after Thousand Trails confirms the membership transfer. hitch.exchange is not responsible for delays or decisions made by Escrow.com or Thousand Trails.
7. Tax reporting (INFORM Consumers Act)
Under U.S. law, hitch.exchange is required to issue a Form 1099-K to sellers whose gross sales on the platform meet or exceed the federal reporting threshold (currently $600 per calendar year). By listing on hitch.exchange, you agree to provide accurate tax identification information and understand that proceeds may be reported to the IRS.
8. Seller representations
By submitting a listing, you represent and warrant that:
- You are the legal owner of the membership interest, or are duly authorised to sell it.
- The membership is in good standing and annual dues are current (or you have disclosed otherwise).
- All information provided about the membership is accurate to the best of your knowledge.
- The membership is transferable under Thousand Trails' current policies.
- You are not subject to any legal restriction that would prevent the sale.
9. No guarantee of sale
hitch.exchange does not guarantee that your membership will sell, or at any particular price. Market conditions, contract-specific factors, and buyer demand all influence outcomes. Price guidance provided by the platform is informational only and does not constitute a valuation or appraisal.
10. Limitation of liability
To the fullest extent permitted by law, hitch.exchange's liability to any party in connection with a transaction or use of the platform is limited to the service fee actually received by hitch.exchange in relation to that transaction. hitch.exchange is not liable for indirect, incidental, or consequential damages of any kind.
11. Governing law
These terms are governed by the laws of the State of Indiana. Any dispute arising from use of this platform shall be resolved in the courts of Indiana, and both parties consent to that jurisdiction.
12. Changes to these terms
We may update these terms from time to time. The effective date above reflects the most recent revision. Continued use of the platform after a change constitutes acceptance of the updated terms.
